By purchasing ride package(s) into The Daytona Harley-Davidson 13th Annual Ride For Children, both rider and passenger, hereafter referred to as ‘Participant’ or ‘Releasor’ who hereby provides this Release to Camp Boggy Creek, Inc., Daytona Harley-Davidson, Inc., Destination Daytona, LLC and Bruce Rossmeyer’s Destination Daytona, LLC, including their promoters, ride participants, shareholders, owners, officers, managers, subcontractors, and employees (individually and collectively, ‘Dealer’ or ‘Releasee’) who are involved in any manner in a motorcycle ride called the Daytona Harley-Davidson Ride For Children  (’The Ride’) which will occur on October 14, 2007 and engaged by Participant and others which is organized by Dealer; or, leaves from, arrives at, or is destined to arrive at Dealer’s premises whether or not Participant leaves from, arrives at or is destined to arrive at Dealer’s premises.

PARTICIPANT’S COVENANTS & ACKNOWLEDGEMENTS. In consideration of being permitted to be involved in, observe, or participate as a rider or passenger in The Ride and have access to the Dealer’s premises, the Participant, for himself or herself, and his or her personal representatives, heirs and next of kin, acknowledges, agrees and represents that he or she has, a valid motorcycle license with endorsement, has motorcycle property and liability insurance, is fully capable of riding a motorcycle safely in a group of riders, understands that motorcycle rides (such as The Ride) are a very dangerous activity which can and may result in accidents, injury to person and/or property, and death as a result of sudden and unexpected circumstances resulting in collisions with or the actions of other Participants, non-participants, other motor vehicles, and objects.

RELEASE AND COVENANT NOT TO SUE. Participant hereby releases, waives, discharges Dealer from all liability and/or any claim or demands on account of injury to the person or property or death to Participant from any cause, person or thing, whether caused by the gross negligence or negligence of the Releasee or otherwise, while the Participant was or is participating in The Ride or traveling to of from The Ride; and, and covenants not to sue Dealer for such actions.

INDEMNIFICATION. Participant agrees to indemnify and save and hold harmless the Releasee and each of them from any loss, liability, damage or cost they might incur due to the presence of the Participant in The Ride whether caused by any cause, person or thing, including the gross negligence or negligence of the Releasee, Participant or third party.

ASSUMPTION OF RISK.  Participant assumes full responsibility for and risk of bodily injury, death or property damage due to any cause, person, or thing including the gross negligence or negligence of Releasee, or otherwise, while participating in The Ride. The Participant acknowledges that Dealer is not providing any security or safety measures, such as police escorts or enforcement, background or safety checks of other riders (or any other safety measure of any kind); nor is Dealer taking any safety precautions of
any type for The Ride or in regard to any Participant or non-participant and Participant while fully acknowledging as much, fully assumes all risks as set forth herein.

SCOPE OF RELEASE.  The Participant acknowledges and agrees that motorcycle riding in a group or in The Ride is very dangerous and involves the risk of serious injury or death and/or property damage. The Participant further agrees that the foregoing Release and its contents are intended to be as broad as is permitted by the laws of the State of Florida, and that if any portion (including any word or phrase) of it is held invalid, it is agreed that the balance shall, notwithstanding, be interpreted by the court to be
as broad as possible and continue in full legal force and effect.  It shall have no legal effect on interpretation of this Release that the Dealer has prepared this Release.

The Participant has read and voluntarily accepts this Release and further agrees that no oral representations, statements or inducements apart from the foregoing written agreement have been made which in anyway alters, amends, or changes this Release.
